The Cookie Monster
Cookie Legislation and how it affects you.....and it really does!
As some of you may be aware a new EU legislation has come in about 'cookies' on your website in the last couple of days. See www.ico.gov.uk/
We have been waiting to see how other businesses have handled this new legislation as until now it has not been clear as to the exact requirements you must undertake, and infact still isn't but our findings are as such.
Premium method as per the ICO and NHS
This adds an opt in at the top of your website as well as giving a 'privacy & cookie' policy and list of cookies used see:
http://www.ico.gov.uk/
http://www.norfolk.nhs.uk/
This is the correct method, however very few businesses are opting for this solution.
To carry out this method we would add the opt in form, audit your cookies and add a cookies & privacy disclaimer.
Standard method which seems to being adopted
Most business are adopting a 'privacy & cookie' policy link in the footer of their website which adds policy and list of cookies see:
http://www.number10.gov.uk/privacy-policy/
http://www.amazon.co.uk/gp/BIT/InternetBasedAds
http://marksandspencer.metafaq.com/help/company-website/cookies
To carry this method out we will audit your website for cookies and add the policy with cookie list.
Enforcement of the law
There is a penalty of up to £500,00 for non compliance although it is most likely that the ICO will first give a business the chance to conform to the requirements.
